Terms of Service

1. Acceptance
By using bytario.com you agree to these Terms. If you do not agree, do not use the service. Bytario is a service operated by DMG L&D, LLC, a Florida limited liability company. If you are using Bytario on behalf of an organization, you represent that you have the authority to bind that organization.
2. The service
Bytario provides in-browser file utility tools (image conversion, PDF editing, QR codes, barcodes, metadata stripping, data encoding, text analysis, color conversion) at bytario.com. All processing happens locally in your browser via WebAssembly. Bytario does not upload, store, or retain your files. The paid B2B API at api.bytario.com provides the same conversion engine as server-side HTTP endpoints.
3. Paid API — subscription terms
Subscriptions to api.bytario.com are billed monthly or annually via Stripe. All plans auto-renew at the end of each billing cycle unless canceled through the Stripe Customer Portal before the renewal date. Pro-rated refunds are available within 30 days of any charge — email [email protected]. Each plan includes a hard monthly request quota; when exhausted, additional requests return HTTP 429 until the quota resets on the 1st of the next month. There are no overage charges.
4. Acceptable use
You may not use Bytario to:
- Process content that is illegal in your jurisdiction or ours.
- Reverse-engineer, decompile, or attempt to extract proprietary WASM modules.
- Remove or modify any copyright or attribution notices.
- Disrupt, probe, or overload the service or its underlying infrastructure.
- Resell, white-label, or sub-license the service without a written agreement.
- Share API credentials with third parties or use a single API key across multiple unrelated applications.
- Circumvent rate limits or quota enforcement by any means.
5. Your content
You retain all ownership rights in the files you process. On the consumer site, Bytario never receives those files. On the paid API, files are processed transiently in memory and never persisted. We make no claim to your content and grant no license in it.
6. Intellectual property
The Bytario name, logo, design, and underlying source code are owned by DMG L&D, LLC and protected by copyright, trademark, and other intellectual property laws. Nothing in these Terms grants you a license to use any of them beyond the limited right to access and use the public site as intended.
7. No warranties
THE SERVICE IS PROVIDED "AS IS" AND "AS AVAILABLE," WITHOUT WARRANTIES OF ANY KIND, EXPRESS OR IMPLIED, INCLUDING WARRANTIES OF MERCHANTABILITY, FITNESS FOR A PARTICULAR PURPOSE, AND NON-INFRINGEMENT. We do not warrant that conversions will be lossless for every input, that the service will be uninterrupted, or that any specific defect will be corrected.
8. Limitation of liability
TO THE MAXIMUM EXTENT PERMITTED BY LAW, DMG L&D, LLC SHALL NOT BE LIABLE FOR ANY INDIRECT, INCIDENTAL, SPECIAL, CONSEQUENTIAL, OR PUNITIVE DAMAGES, OR ANY LOSS OF PROFITS, DATA, OR GOODWILL, ARISING OUT OF OR RELATED TO YOUR USE OF THE SERVICE. IN NO EVENT SHALL OUR TOTAL LIABILITY EXCEED ONE HUNDRED U.S. DOLLARS ($100) OR THE AMOUNT YOU PAID US IN THE PRECEDING TWELVE MONTHS, WHICHEVER IS GREATER.
9. Indemnity
You agree to indemnify and hold DMG L&D, LLC harmless from any claim arising out of your misuse of the service or violation of these Terms.
10. DMCA / Copyright
DMG L&D, LLC respects the intellectual property rights of others. If you believe content processed through our API infringes your copyright, please send a notice to [email protected] identifying the copyrighted work, the allegedly infringing material, and your contact information. Note that because the consumer site processes files entirely in-browser and we never receive or store them, DMCA notices regarding consumer-site usage should be directed to the party who created or distributed the content.
11. Changes
We may revise these Terms at any time. Material changes will be announced on this page with an updated "Last updated" date and, for API subscribers, via email at least 30 days before they take effect. Your continued use of the service after the effective date constitutes acceptance.
12. Arbitration
Arbitration. Any dispute arising out of or relating to these Terms or your use of the Service shall be resolved by binding arbitration administered by the American Arbitration Association under its Commercial Arbitration Rules. The arbitration shall be conducted in the State of Florida. The arbitrator's award shall be final and binding and may be entered as a judgment in any court of competent jurisdiction. EACH PARTY WAIVES THE RIGHT TO A JURY TRIAL AND THE RIGHT TO PARTICIPATE IN A CLASS ACTION.
13. Governing law
These Terms are governed by the laws of the State of Florida, United States, without regard to conflict-of-laws principles. Any dispute shall be resolved in the state or federal courts located in Florida.
14. Severability
Severability. If any provision of these Terms is held unenforceable, the remaining provisions continue in full force and effect.
15. Entire Agreement
Entire Agreement. These Terms, together with the Privacy Policy and DPA (where applicable), constitute the entire agreement between you and DMG L&D, LLC regarding the Service.
